EPA RRP Rule Exclusions

The Renovation, Repair and Painting Final Rule (RRP Rule) has outlined some renovation circumstances in which exclusions apply.  We want to stress that it may not be a good idea to take advantage of these exclusions.

  • Renovation activities where affected components do not contain lead-based paint.
    • Remember even if you test for lead-based paint and find none.  There could still be lead-based paint on the surface, just not the area that you tested.  Because of this, you still can’t use the prohibited practices.  Open-flame burning or torching, using a heat gun above eleven-hundred degrees Fahrenheit, or using power tools without HEPA shrouds or attachments are all still prohibited.
  • Emergency renovations (requires cleanup and cleaning verification).
    • This exclusion only applies during the mitigation of the emergency.  Upon mitigating the emergency the renovation firm is required to work in a lead-safe manner.
  • Minor repair and maintenance activities.
    • Six square feet or less of paint per room for interiors, and twenty square feet or less of paint per side of the building for exteriors.  Again, just because the exception exists doesn’t mean it is a good idea to spread the dust that is created.  Maybe one you find an exclusion you don’t have to post signs and build barrier doors.  However, you should always control the dust!  Leaving just a little leaded paint dust behind can have life altering consequences for your customers.
      • Note: This exclusion does not apply to window replacement, demolition or activities involving prohibited practices.
  • Renovations performed by homeowners in their own homes.
    • Feel free to poison yourself and your family.  Not a wise decision, you should always work lead-safe when you find lead covered coatings.  Remember just a sugar packet full of leaded dust can lead to devastating consequences for you and your families health.
    • Documenting any buyer requested repair, or hiring an EPA Certified Firm is always a great best practice when selling your home.
