OSHA fines are going up!

When President Barack Obama signed the budget bill this past year it included a provision to strike the Federal Civil Penalties Inflation Adjustment Act of 1990.  This act allowed OSHA fines to be exempt from rising due to normal inflation.  With the singing of the new budget on November 2nd, OSHA is now directed to issue a new interim rule increasing its penalties.  This means that the OSHA fines will be going up!  The new rule will raise proposed OSHA fines up to 75 percent in some cases.

OSHA has until August 1st, 2016 to issue the adjusted proposed penalty amounts, so you have some time to prepare. We recommend that you at the very least answer the following simple questions.  If you answer no to any of these questions you will be putting yourself at a high risk to be fined in the future.  Please take a couple a minutes to find out where you stand:

  1. Does every employee attend a safety orientation prior to beginning work?
  2. Is there a formal safety training program in place?
  3. Does your company perform safety inspections on all facilities and projects at least monthly?
  4. When safety violations are identified is there written documentation of the discipline?
  5. Does your company have a formal health and safety manual?
